The City of Cape Town has published new amendments to its streets, public places, and the prevention of noise nuisances by-law for public comment.

The by-law allows for an authorised official to instruct a person to leave and remain out of an area, as well as allowing officials to stop, enter and search any vessel, vehicle, premises or person without a warrant.

The by-law relates to the management of public places, noise levels and other incidental matters on all properties within Cape Town, and specifically section 22 of the by-law, which guides the City’s actions on transgressions and the recovery of costs where applicable.

Comments and objections may be submitted until 17 May 2020 and can be done so, right here.

  1. This law is absolutely OUTRAGEOUS and should not be allowed! In a perfect world, law enforcement officials would only enforce this law against criminals; but we do not live in a perfect world. This law WILL be used and ABUSED by CORRUPT police COUNTLESS times against INNOCENT citizens. It is a complete and total violation of our right to Privacy and Dignity – to not be treated like criminals for no apparent reason. STOP this law at ONCE! It is an outrage.

  2. I do not give my vote towards this Amendment, it is a gross violation of my rights to privacy and I will not give in to it. Should the situation arise I will not allow my privacy to be invaded without a warrant. The state cannot just make decisions without my consent as human being, a person and someone with rights that the state pretends to protect.

  3. No person should ever be made to feel like a criminal in this way and be subjected to this kind of invasion of privacy. This kind of action should only be taken when there is full justification and suspicioun, and then only with a legal court order.

  4. Ridiculous! This takes away the right of ownership, privacy and protection. A warrant needs to be obtained for this as is the case everywhere else in the world. Yet another way to cause citizens to live in fear of the people that has sworn to protect them.

  10. This is utter nonsense. Invasion of privacy? Until the government pays for my bond and car Cj installment, they’ll need a PERMIT to invade my privacy!! FUCK NO!

  12. Don’t think it will work as the law enforcement don’t know there limits as it is and don’t know what to do when they have to deal with real crimes. How about investing in proper training for law enforcement before you take away the rights of the citizens.

  15. I do NOT give my vote or agree with this. What happened to the right to privacy. A private vehicle or residence should ALWAYS require a warrant to be searched with reasonable suspicion!!!!!! I am sure we can all sign a petition to outlaw this

  18. Unacceptable. Violates the Constitution of Rep of South Africa. See Bill of Rights- Rights- Human Dignity- Equality- PRIVACY etc etc. I totally disagree with the amendment as it is egregious in my opinion!!!

  19. As a woman this is terrifying. I have once been followed and harassed by an ambulance driver on a road rage vent in Wynberg. I have met someone who was sexually assaulted by a police officer. Criminals often hide in law enforcement or security. It’s part of a certain psychological profile. This law will give those individuals more opportunities to abuse their power. How is constitutional?

  20. I am vehemently against this policy. Nobody should be given communist authority over the public. We are a democracy and not a dictatorship. No so called authoritian force must be given this power to make a decision. Nobody can respect or trustsauthorities in SA not to abuse their position. I do not agree to this.

  22. The police are suppose to Protect and serve the people of this country and this province, by being alowed to just enter a home or a vehicle without a warrant is just disrespectful towards us all. We is the sense of privacy, where is the respect for another human and their property.

We now going to be expose to all abuse and criminal activities in the name of search without warrant. Please we are not stupid CCT. I will not allow anyone into my house without permission.
